of March 7, 2005 as presented.
ADDITIONS/DELETIONS
TO THE AGENDA:
Request to delete agenda item “D” and add agenda item “N” AUTHORIZE CLERK AND SUPERVISOR TO SIGN REPLACEMENT DEED FOR CONTAINERS SPECIALTY PROPERTY. There were no objections.

FACILITIES EXEMPTION CERTIFICATE TO HOUGEN MANUFACTURING

Hodge, 3234 Ridgecliffe was against the issuance of the IFT.

MOTION
BY D. CARLTON, SECOND BY J. MACGILLIVRAY,
WHEREAS, Hougen
Manufacturing,
has filed an application for an Industrial Facilities Exemption Certificate
covering the Industrial Development District established by the Board of
Trustees of the Charter Township of Flint on November 6, 1995; and
WHEREAS, a
public hearing was held by the Board of the Charter Township of Flint pursuant
to the provisions of Act 198 of the Public Acts of 1974, as amended, on March
21, 2005; and
WHEREAS, the
applicant, the Township Assessor and a representative of the affected taxing
units were each given notice as required by said Act and were each given an
opportunity for a hearing; and
WHEREAS, the
Board of the Charter Township of Flint finds the matters presented at the
public hearing that;
1. The
granting of the Industrial Facilities Exemption Certificate, when considered
together with the aggregate amount of Industrial Facilities Exemption
Certificates previously granted and currently in force, shall not have the
effect of substantially impeding the operation of the Charter Township of Flint
or the Charter Township of Flint or impairing the financial soundness of any
taxing unit which levies an ad valorem property tax in the Charter Township of
Flint.
2. The
commencement of the construction of the facility occurred not earlier than six
months before the filing of the application for the Industrial Facilities
Exemption Certificate.
3. The
application relates to a construction program which, when completed,
constitutes a new facility within the meaning of said Act 198 and which shall
be situated within a Plant Rehabilitation District of Industrial Development
District duly established by the Charter Township of Flint, which is eligible
under said Act 198 to establish the district and which was established upon a
request filed before the commencement of the rehabilitation of the facility.
4. Completion
of the facility is calculated to, and will at the time of issuance of the
certificate, have the reasonable likelihood to create employment in the
community in which the facility is situated.
5. Completion
of the facility shall not have the effect of transfer of employment from one or
more local government units of the state to the Charter Township of Flint.
6. The
aggregate State Equalized Valuation of the property proposed to be exempt under
the application, considered together with the aggregate state equalized
valuation of property exempt under certificates previously granted and
currently in force will not exceed 5% of the state equalized valuation of the
Charter Township of Flint.
7. Completion
of the facility does not constitute merely the additional machinery and
equipment for the purpose of increasing productive capacity but rather is
primarily for the purpose and will primarily have the effect of restoration of
obsolete industrial property.
NOW, THEREFORE BE IT RESOLVED, by the
Township Board of the Charter Township of Flint that:
1. The
Township Board determines that the granting of the Industrial Facilities Exemption
Certificate considered together with the aggregate amount of certificates
previously granted and currently in force under Act No. 198 of the Public Acts
of 1974 shall not have the effect of substantially impeding the operation of
the Charter Township of Flint or impairing the financial soundness of a taxing
unit which levies ad valorem property taxes in the Charter Township of Flint.
2. The
application of Hougen Manufacturing for an Industrial Facilities Exemption
Certificate with respect to a new addition of the facility described parcel of
real property situated within the Industrial Development District, to-wit:

and the same is hereby approved.
3. The
Industrial Facilities Exemption Certificate when issued shall be and remain in
force and effect for a period of twelve (12) years.
